Terms of Use

These Terms of Use ("Terms") govern your use of stuartoncology.com (the "Site") and the text messaging program operated by Stuart Oncology Associates, P.A. ("Stuart Oncology," "we," "us," or "our"). By using the Site or opting in to our text messages, you agree to these Terms. If you do not agree, please do not use the Site or the text messaging program.

Not medical advice

The content on this Site is for general information only. It is not medical advice and does not replace an evaluation by a qualified healthcare provider. Do not delay seeking care because of something you read here.

If you have a medical emergency, call 911 or go to the nearest emergency room. Do not use the Site, email, or text messages for urgent medical needs.

No physician-patient relationship

Using the Site, submitting a form, or sending us a message does not create a physician-patient relationship. That relationship begins only when we accept you as a patient and you are seen by one of our providers.

Appointment and second opinion requests

A request submitted through the Site is not a confirmed appointment. Your appointment is confirmed only after our staff contacts you. Please do not include detailed medical information in website forms.

Text Messaging Terms (SMS)

Program description. If you opt in, Stuart Oncology Associates will send you text messages related to your care, including check-ins for our care management and remote monitoring programs (such as chronic care management, principal care management, and remote therapeutic monitoring), reminders to complete readings or questionnaires, and appointment reminders.

Consent. You opt in by providing your mobile number and agreeing to receive text messages when you enroll in one of our care management or remote monitoring programs, on your patient intake form, or by telling our staff. Consent to receive text messages is not a condition of receiving care or any other service from us.

Message frequency. Message frequency varies based on your care program and appointments.

Cost. Message and data rates may apply, depending on your mobile plan. We do not charge for text messages.

Opt out. Reply STOP to any message to stop receiving text messages. You will receive one final message confirming your opt-out. To rejoin, reply START or contact our office.

Help. Reply HELP to any message for help, call (772) 276-7242, or email contact@stuartoncology.com.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device, and is not guaranteed.

Not for emergencies or sensitive information. Text messages are not monitored for emergencies and are not encrypted. Do not text us about urgent symptoms or send detailed medical information by text. Call our office, or call 911 in an emergency.

Changes to your number. Tell us promptly if you change or give up your mobile number so that messages are not sent to someone else.

Privacy. We do not share your mobile number or text messaging consent with third parties or affiliates for marketing purposes. See our Privacy Policy for details.

Third-party services and links

The Site links to services operated by third parties, including our patient portal and online payment page. Those services are governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party sites.

Intellectual property

The Site and its content, including text, images, logos, and design, are owned by Stuart Oncology Associates, P.A. or its licensors and are protected by law. You may view and print content for personal, non-commercial use. Any other use requires our written permission.

Acceptable use

You agree not to:

• Use the Site for any unlawful purpose

• Submit false information or impersonate another person

• Attempt to gain unauthorized access to the Site or its systems

• Interfere with the Site's operation or security

• Copy or collect Site content by automated means without our permission

Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or current at all times.

Limitation of liability

To the fullest extent permitted by law, Stuart Oncology Associates, P.A. and its physicians, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the text messaging program. Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a patient regarding the medical care you receive.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts serving Martin County, Florida.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they were last revised. Your continued use of the Site or the text messaging program after changes are posted means you accept the updated Terms.
