Stuart Oncology Associates, P.A. ("Stuart Oncology," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect through stuartoncology.com (the "Site") and our text messaging program, how we use it, and the choices you have.
How this policy relates to HIPAA
This policy covers the Site and our text messaging program. Medical information we hold as your healthcare provider is protected by the Health Insurance Portability and Accountability Act (HIPAA) and is described in our Notice of Privacy Practices, which is available at any of our offices and on request. If this policy and the Notice of Privacy Practices ever conflict about your protected health information, the Notice of Privacy Practices controls.
Information we collect
Information you give us. When you request an appointment, request a second opinion, refer a patient, apply for a job, or contact us, we collect the information you submit. This may include your name, phone number, email address, date of birth, insurance details, and the content of your message.
Text messaging information. If you opt in to text messages, we collect your mobile phone number, a record of your consent (date, time, and how you opted in), your opt-out status, and the messages exchanged with us.
Information collected automatically. When you visit the Site, we and our service providers may collect your IP address, browser and device type, pages viewed, and the date and time of your visit, using cookies and similar technologies.
Third-party services. Our patient portal and online payment page are operated by third-party vendors and are governed by their own terms and privacy policies. We do not collect payment card numbers on this Site.
How we use information
We use the information we collect to:
Respond to your requests and schedule appointments
Provide care and run our practice
Send text messages you have agreed to receive
Process billing and insurance matters
Maintain, secure, and improve the Site
Comply with legal and regulatory obligations
Text messaging (SMS) privacy
We do not sell, rent, or share your mobile phone number or your text messaging consent with third parties or affiliates for their marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties. The only exception is service providers that help us deliver messages, such as our messaging platform and mobile carriers, which may use this information only to provide that service to us.
Text messages are not encrypted and may be seen by anyone with access to your phone. We limit the health information included in text messages. You can opt out at any time by replying STOP to any message. See the Text Messaging Terms in our Terms of Use for details.
How we share information
We do not sell your personal information. We share information only in these cases:
Service providers. Vendors that host the Site, deliver messages, process payments, or support our operations, under agreements that limit their use of your information. Where required, we have business associate agreements in place.
Treatment, payment, and healthcare operations. With other healthcare providers, insurers, and others as permitted by HIPAA and described in our Notice of Privacy Practices.
Legal requirements. When required by law, court order, or government request, or to protect the rights and safety of our patients, staff, or others.
Practice transition. In connection with a merger, sale, or transfer of the practice, subject to applicable law.
None of the categories above include text messaging opt-in data and consent, which is not shared with third parties as stated in the section above.
Cookies and analytics
The Site uses cookies and similar technologies, including Google Analytics, to operate properly and to understand how visitors use it. You can block or delete cookies in your browser settings, or opt out of Google Analytics using Google’s browser add-on. Some features of the Site may not work as intended if you do.
Data security
We use administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is completely secure. Please do not send sensitive medical details through website forms, email, or text message. Use the patient portal or call our office instead.
Data retention
We keep information for as long as needed for the purposes described in this policy and as required by law, including medical record retention laws. We keep text message consent and opt-out records for as long as needed to honor your choices and meet legal requirements.
Children's privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. A parent or guardian should contact us directly about care for a minor.
Your choices and rights
Text messages. Reply STOP to any message to opt out. Reply HELP for help.
Health information. Your rights to access, amend, and receive an accounting of disclosures of your medical records are described in our Notice of Privacy Practices.
Other information. To ask about, update, or request deletion of information collected through the Site, contact us using the details below. We will respond as required by applicable law.
Changes to this policy
We may update this policy from time to time. The effective date at the top shows when it was last revised. Changes take effect when posted on this page.
